ಕರ್ನಾಟಕ ಸರ್ಕಾರದ ನಡವಳಿಗಳು
ವಿಷಯ: ದಿನಾಂಕ: 01.04.2020 ರಿಂದ 31.03.2021ರವರೆಗೆ ಪಾವತಿಸಬೇಕಾಗಿದ್ದ ವ್ಯತ್ಯಸ್ಥ ತುಟ್ಟಿಭತ್ಯೆ (ವಿ.ಡಿ.ಎ) ಯನ್ನು ಮುಂದೂಡಿ ಹೊರಡಿಸಿದ ಸರ್ಕಾರದ ಆದೇಶವನ್ನು ಹಿಂಪಡೆಯುವ (Withdraw) ಬಗ್ಗೆ.
ಓದಲಾಗಿದೆ: ಸರ್ಕಾರದ ಆದೇಶ ಸಂಖ್ಯೆ: ಕಾಇ 72 ಎಲ್ ಡಬ್ಲ್ಯೂಎ 2020 ದಿನಾಂಕ: 20.07.2020.
ಪ್ರಸ್ತಾವನೆ:
ಮೇಲೆ ಓದಲಾದ (1) ರ ಸರ್ಕಾರದ ಆದೇಶದಲ್ಲಿ ಕೋವಿಡ್-19 ತುರ್ತು ಸಂದರ್ಭದ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಘೋಷಿಸಲಾಗಿದ್ದ ಲಾಕ್ ಡೌನ್ ಅವಧಿಗೆ ವೇತನವನ್ನು ನೀಡಬೇಕೆಂದು ಕೇಂದ್ರ ಸರ್ಕಾರದ ಮಾರ್ಗಸೂಚಿಗಳಲ್ಲಿ ತಿಳಿಸಿದ್ದು, ತುರ್ತು ಪರಿಸ್ಥಿತಿಯ ಈ ಸಂದರ್ಭದಲ್ಲಿ ಉದ್ಯೋಗದಾತರ ಹಿತ ರಕ್ಷಣೆಯನ್ನು ಪರಿಗಣಿಸಿ, ದಿನಾಂಕ: 01.04.2020 ರಿಂದ 31.03.2021ರವರೆಗೆ ಪಾವತಿಸಬೇಕಾಗಿರುವ ವಿಡಿಎ ಮೊತ್ತವನ್ನು ಮುಂದೂಡಿ ಆದೇಶಿಸಲಾಗಿರುತ್ತದೆ.
ಸರ್ಕಾರದ ಈ ಆದೇಶದ ವಿರುದ್ಧ ಕಾರ್ಮಿಕ ಸಂಘಟನೆಗಳು ಮಾನ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ರಿಟ್ ಅರ್ಜಿ ಸಂಖ್ಯೆ: 9413/2020 ಪ್ರಕರಣವನ್ನು ದಾಖಲಿಸಿದ್ದು, ಸದರಿ ಪ್ರಕರಣಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಮಾನ್ಯ ಉಚ್ಛ ನ್ಯಾಯಾಲಯವು ದಿನಾಂಕ: 11.09.2020ರಂದು “The impugned order, as observed earlier, ex-facie illegal and deserves to be stayed. Till the final disposal of the petitions, the execution and operation of the order bearing No. LD 72 LWA 2020 dated 20" July 2020 will remain stayed” ಎಂಬುದಾಗಿ ತಡೆಯಾಜ್ಞೆ ನೀಡಿರುತ್ತದೆ.
ಈ ಪ್ರಕರಣದಲ್ಲಿ ದಿನಾಂಕ: 23.07.2021ರಂದು ನಡೆದ ವಿಚಾರಣೆಯಲ್ಲಿ, “If the State Government wants to withdraw the impugned order, obviously they do not require the leave of the Court.
